Term of use

1. Acceptance of Terms of Service

1.1 Synon,Inc. (hereinafter “Synon”) provides our sites services (hereinafter “Synon Services”) to you under the adherence of the conditions of the following Terms of Service (hereinafter “Terms of Service”).

1.2 In order to use Synon Services, you must first agree to the terms and provision of Terms of Service.
Or; You may not use Synon Services if you do not accept the terms and provision of Terms of Service.

2. Prohibited Acts

In order to use Synon Services, you agree not conduct any of the following acts.

2.1 Register to the site using false information about yourself.

2.2 Conduct any act that infringes upon or possibly infringes upon other users’, any third parties, or Synon’s intellectual and/or any other types of property rights and/or any other rights.

2.3 Conduct any act that infringes upon or possibly infringes upon other users’, any third parties, or Synon’s property, privacy and the right of portrait.

2.4 Conduct any act that causes a disadvantage or loss or possibly causes a disadvantage or loss to other users, any third party, or Synon.

2.5 Conduct any act that transfers or receives or possibly transfers or receives other users’ or any third party’s personal information.

2.6 Conduct any act that goes or promotes or possibly goes or promotes against public order and morals.

2.7 Provide information to other users or any third party that goes against public order and morals.

2.8 Publish or promote the publishing of information that is recognized or possibly recognized as being harmful to minors.

2.9 Conduct any act that violates or possibly violates laws or is considered a criminal act and regulations or do any act that assists or might assist any act that violates laws and regulations or is considered a criminal act.

2.10 Knowingly provide information that is or possibly is false.

2.11 Any acts to illicitly alter information that other users, any third parties, or Synon entered on the Internet.

2.12 Impersonate another user, third party, or Synon.

2.13 Conduct any act that releases a harmful computer virus, code, file, program, etc or any act that provides information on or a link to a place that does.

2.14 Conduct any act that interferes or possibly interferes with the management of Synon Services and/or any other service that Synon provides.

2.15 Conduct any act that harms or possibly harms the credibility or reputation of Synon Services and/or any other service that Synon provides.

2.16 Provide, re-sell, or remarket any similar service as Synon Services to a third party by utilizing Synon Service regardless of whether or not compensation is received.

2.17 Any other acts that we deem as inappropriate. Synon, in its sole discretion, may terminate the use of Synon Service, which includes changing information on the site and terminating any users membership without prior notice or consent, if any of the aforementioned acts are confirmed to have been committed.
You acknowledge that any breach of Terms of Service will be dealt with according to Synon’s rules and regulations. You understand that Synon will on no conditions accept any questions or complaints regarding our measures against those who break this agreement nor shall Synon be held responsible for any such termination.

3. The use and management of users information

We reserve the right to disclose your information, usage history and contents of e-mail or messages when any of the conditions below are applicable.

3.1 When requested by law to disclose information regarding use by the courts and/or any other judicial and administrative body.

3.2 When a problem of maintaining Synon Services or systems occurs.

3.3 When there is a violation of laws, or provisions of Terms of Service or when we believe that any information is socially unacceptable.

3.4 When Synon believes disclosure is necessary to protect the right or interests of Synon, a registered user, or third parties interests.

4. Intellectual property rights

4.1 When you post information on Synon Services, such information in its entirety belongs to you. However, if you post information that is not protected under Synon’s privacy policy, the right to use (including but not limited to duplication rights, distribution rights, adaptation rights, and public transmission rights including the rights of making transmittable) such information will be granted on a non exclusive basis and can be used anywhere without compensation. You shall not exercise your personal rights as author on Synon and those designated by Synon.

5. Disclaimer

5.1 You shall solely be held responsible for solving any troubles or disputes that occur with other users or any person involved. Synon shall not be held responsible for such troubles or disputes.

5.2 You shall be responsible for your own actions in using Synon Services. In the case where the contents of a posting violates laws or infringes upon any person’s copyright or intellectual property, you may be held responsible to civil liabilities such as compensation for damages and criminal liability.

5.3 Synon shall be exempt and free from any rights you claim, any allegations, legal actions, suits, and all forms of litigation proceedings filed against Synon if you do not abide by the law and/or the provisions of Terms of Service.

5.4 Synon, in its sole discretion, may discontinue, temporarily or permanently, Synon Services. Synon shall not be responsible for any loss, damages, costs, or expenses that may be incurred by the user due to the suspension or discontinuation of Synon Services.

5.5 Synon will not be held liable to pay reparations for any damages you incurred from using Synon Services (including but not limited to any damages due to breach or loss of information incurred from acquiring information from using Synon Services).

6. User’s consent and legal procedures

6.1 By using Synon Services you accept and agree to be bound by the terms and provisions of the Terms of Service. Synon reserves the right to change the Terms of Service in its sole discretion at any time. Synon will notify the contents of such changes by the manner separately set by Synon. Even if the notice is not accessible, you acknowledge and agree that the terms and provision of the Term of Service after such changes will be valid and applicable.

6.2 In the case of any dispute between you and Synon regarding the use of Synon Services, the first instance of court proceedings shall be brought exclusively to the Osaka Summary Court or the Osaka District Court as the competent courts

7. Applicable Laws

7.1 Anything concerning the formation, validity, execution and interpretation of this agreement will be governed by the laws of Japan.

The Terms of Service went into effect from the 12th of January, 2009.
